Terms and Conditions for Ordering Services from Atilo
1. Payment Options
- Pay Now: By selecting the “Pay Now” option, you agree to pay our agency fee of £795.00, with nothing further due on completion.
- Pay on Completion: By selecting the “Pay on Completion” option, you agree to pay an upfront agency fee of £200.00, followed by a completion fee of £1,700.00 upon successful sale and completion of the property.
We reserve the right to charge a completion fee if we introduce a buyer and a sale is agreed upon, but you subsequently withdraw from the sale. If the buyer withdraws, there will be no charge to you.
Both payment options include 9 months of marketing.
2. EPC (Energy Performance Certificate)
We will arrange an EPC if purchased. If you provide your own EPC, we require a copy or the unique reference code before marketing the property.
3. Media
The price includes property descriptions, floor plans, photos, and measurements. Each property receives one home visit; additional visits may incur a charge.
4. Thirty Day Money Back Guarantee
If you select the “Pay Now” option and are dissatisfied with our service, we will refund your initial agency fee. You must inform us within 30 days of instructing us to market your property. Refunds for additional services such as EPCs, premium listings, social media, viewing packages, and video packages are not available, as these are arranged through third parties.
5. Sole Agency Agreement
There is no sole agency agreement. You may market your property with other agents. If it sells through another agent, you forfeit any initial agency fee (unless covered by the 30-day money-back guarantee) or additional marketing package fees.
6. Tie-In Period
There are no tie-in periods. You may request that we stop marketing your property at any time. Initial fees paid are non-refundable, except as covered by the 30-day money-back guarantee. If the property sells through another agent or privately to a purchaser initially introduced by us, our agency fee is due on completion.
7. Withdrawal Fee
There is no withdrawal fee with either payment option.
8. Viewings
All viewings must be arranged through us, the agent, and accompanied by you, the vendor, unless a viewing package has been purchased.
9. Accompanied Viewings
We offer an unlimited accompanied viewing package, valid for six months from the day of instruction.
10. Photographer Cancellation Fee
If you cancel or rearrange the photographer’s home visit within 24 hours of the appointment, a cancellation fee of £190.00 will apply.
11. Money Laundering Regulations
As a legal requirement, we must verify all registered vendors associated with the property in accordance with money laundering regulations.
12. Verifying Sales Particulars
You must formally verify the property details before advertising. A draft advert will be emailed to you for confirmation of accuracy.
13. Home Report (Scotland Only)
Vendors selling property in Scotland are responsible for providing a Home Report, as required by law.
14. Estate Agents Act 1979
We are required to disclose any interests our estate agents, employees, or relatives may have in your property. We will provide such details if necessary. In accordance with the Estate Agents (Provision of Information) Regulations 1991, we must inform you of our intention to offer prospective purchasers insurance, financial services, estate agency services, and any other special offers that may be available for which we may earn commission.
15. General Provisions
We take no responsibility for damage or theft to the property or land if it is left vacant during the agency period.
16. Complaint Procedures (The Property Redress Scheme)
Atilo is a member of The Property Redress Scheme (PRS) and adheres to their code of practice.
Acceptance of Terms
By agreeing to these terms and conditions, you enter into a legally binding contract with Atilo. You confirm that you are entitled to sell the property and that all parties involved in joint ownership agree to these terms. You also agree that all information provided is correct and accurate to the best of your knowledge.
